These Terms of Service govern your use of shirleynot.com and any purchase you make from us. By using this site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

Who we are

ShirleyNot is an online store selling print-on-demand apparel and gifts. You can reach us at support@shirleynot.com.

Our products

Every item is printed to order. Product photos and mockups are representative; actual colour, print placement, and garment shade can vary slightly between items and between screens. Slight variation is normal for print-on-demand and is not a defect. Size chart measurements are approximate.

Prices and payment

All prices are in US dollars and may change at any time without notice. We do our best to keep pricing and product information accurate, but errors happen. If an item is listed at an incorrect price, we may cancel the order and refund you in full, even after you've been charged.

Orders

We reserve the right to refuse or cancel any order, at any time, for any reason, including suspected fraud, resale, or an unauthorised transaction. If we cancel your order, we'll refund you in full.

Personalised products

Some products let you supply your own text. You are responsible for what you enter, including its spelling and accuracy, and you confirm you have the right to use it. We reserve the right to refuse or cancel any personalisation that is unlawful, infringes someone else's trademark or copyright, impersonates a real person, or is hateful, harassing, or obscene. If we refuse, we'll refund you in full. See our Return and refund policy for what we can and can't fix on personalised items.

Intellectual property

All designs, slogans, artwork, the Shirley character, our logo, product photos, and site copy are owned by ShirleyNot and protected by copyright and trademark law. You may not reproduce, resell, or use our designs for commercial purposes without written permission. Buying a product gives you the product, not the design rights.

Acceptable use

You agree not to use this site for any unlawful purpose, to scrape or copy it, to interfere with its operation, or to attempt to gain unauthorised access to any part of it.

Third-party services

Our products are produced and shipped by third-party print providers, and payments are handled by third-party processors. Their terms and privacy practices apply to their part of the process.

Disclaimer and limitation of liability

This site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, except those that cannot be excluded by law. To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits any rights you have under mandatory consumer protection law.

Indemnification

You agree to indemnify and hold ShirleyNot harmless from any claim arising out of your breach of these terms, or out of personalisation text you supplied.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. This does not deprive you of any mandatory consumer protection rights available to you under the law of your state of residence.

Changes

We may update these terms at any time by posting the revised version on this page. The version in effect when you place an order is the version that applies to that order.
